Radnor to Settle with Former Manager Bashore

The document will put Dave Bashore's 2009 termination, and the legal fight around it, to rest.

 

At its meeting on Monday Radnor Township’s Board of Commissioners will likely vote to settle with the former manager it fired four years ago.

According to the settlement document, Dave Bashore will release all claims to $277,508 in accrued leave and benefit pay, pay $80,000 to the township, and withdraw legal actions he has related to his 2009 termination.

Bashore was fired after eight years when the then-Board of Commissioners said he made hundreds of thousands of dollars of inappropriate expenditures and provided lump-sum bonuses to employees without board approval.

In the settlement, Radnor would agree to not pursue a $1 million “surcharge” action filed against Bashore in Delaware County’s Court of Common Pleas, and agrees to pay him a monthly pension benefit and other related benefits starting in 2018.

The township also agrees to sign and return any paperwork to allow Bashore access to his tax-deferred compensation account and after-tax retirement savings plan account, which Bashore said the township blocked his access to.

According to the document, an integral part of the settlement will be an asset disclosure affidavit from Bashore and his wife, Kelly. The reason, township solicitor John Rice told Radnor Patch, to prove Bashore's inability to pay more on the township’s judgement.

I guess I, like many other residents, assumed that Radnor Township had their financials audited by an outside service on a regular basis. Isn't there a state and/or county requirement to do so?

Yes, and the township received awards from the GFOA for it. But that does not mean that the GFOA delves into the question of: Is what's on paper really what is happening, and they are not judging should this much be spent on that, etc. If I recall correctly, their auditors recommended that make certain unfunded liabilities known, which did not happen.

Radnor does have an annual audit. Unfortunately, audits are not a guarantee that fraud will be detected. Detection of fraud is even more difficult to detect if perpetrated by senior management.

Post-Bashore, the board of commissioners' established, first, the Citizens Budget and Finance Advisory Committee (CBFAC) and, then, the Citizens Audit Review & Financial Advisory Committee (CARFAC), and hired a very competent Township Manager (Bob Zienkowski) and Finance Director (Bill White). With these moves, the Township now has significantly stronger safeguards to help prevent this from happening again.

Considering what transpired, the financial condition of Radnor and the extremely generous pension and health care benefits provided by the Township, this is very disappointing. I hope a good explanation is provided on Monday evening.

He gave staff an himself big bonuses every year he tiik it from the sewer fund if it was not for john osborne he would still be doing it .Some of our boc still think he is a great guy
