Wayne Bed and Breakfast Inn will open its doors to guests on Mother's Day.

It took three years and a legal battle, but the is about to open.

Owners Traudi and Bob Thomason have wanted to open up their home to paying guests for years. It is the perfect place for it, Traudi has maintained all along.

There will be five guest bedrooms and five guest bathrooms. The house, which is about 100 years old, features a living room, sitting room and dining room for guest use as well as a wrap-around porch and a swimming pool.

And in August, the that Radnor Township’s zoning code did not allow for bed and breakfasts.

In December 2009 the Thomasons sought zoning relief from the township’s Zoning Hearing Board, arguing that the zoning code makes no provision bed-and-breakfasts and is therefore an unconstitutional exclusion.

But they were denied that challenge by the board, which found that the township allows for “rooming houses” in one residential zoning district.

Rooming houses would include by its definition “a small upscale bed-and-breakfast establishment,” according to the board’s opinion.

But the Thomason’s challenged that finding, and the Delaware County Court of Common Pleas agreed with them, as did the Commonwealth Court in its affirmation of the lower court’s ruling.
